But I did not serve the deputy -- a One Legal primer for Sheriff Deliveries for UDs

Evictions are not the most enjoyable job type we perform, but they are a necessary one. As such, One Legal offers a complete Unlawful Detainer workflow from service to posting to submission of Writs of Possession to the Sheriff's department. This article focuses on that last crucial piece of the legal eviction process.

With the COVID-19 Relief Act, a moratorium was placed on evictions nationwide. Now, as many of those protections are being lifted, Unlawful Detainer actions are becoming a regular occurrence again. By current estimates, approximately 1 out of every 20 Unlawful Detainer actions result in forcible lockout as executed by the local Sheriff's Civil Division.

DELIVERY DETAILS (Eviction Writs)

Once a Writ of Possession is issued, you'll receive a packet for delivery to the applicable Sheriff's department for execution. The packet for Writs always includes:

  • Issued Writ of Possession (either electronic or hardcopy as per local preference)

  • Sheriff's Instructions (SER-001 and SER-001A in most jurisdictions)

  • Payment/check for $180.00 to the Sheriff (this will be an uploaded eCheck which will need to be printed on the special check stock that we have shipped to you)

    ​NOTE: There may be additional copies, Declaration for Electronic Writ, or other local forms required -- please refer to the Instructions on that job for exact details.
    ​If your understanding of the elements of a successful eviction packet submission do not match those instructions, please reach out to us via a note on the job immediately.

Most counties have a single location for these Sheriff Deliveries, but some larger counties -- including Los Angeles, San Diego, Orange County, San Bernardino - have multiple offices. Sheriff Deliveries will display as "Courier/Delivery Services" in the Job Type field.
The Service Level Agreement for these jobs are Standard (5 days from acceptance) and Rush (within 24 hours), though the expectation with such time-sensitive jobs is on the urgent side, so delivery by the next day, if at all possible, is strongly encouraged.

CLOSEOUT DETAILS

Once you've delivered the Writ to the Sheriff's Civil Division, please ensure that the following information is placed back in each job:

  • "Stamped received copies of the documents submitted to the Sheriff
    (Writ, Instructions, etc.)

  • Sheriff Levy Officer File Number (on the SER-001A) and/or Lockout Date

  • Receipt for the $180.00 eviction fee payment

Or, if submitted unsuccessfully, the Rejection Notice needs to be uploaded immediately.
